QTQ NEWS JUNIOR CADET COMPETITION CONDITIONS OF ENTRY
1. Competition, Conditions and Promoter
1.1. The competition is known as the QTQ Junior Cadet Competition (the Competition).
1.2. By entering the Competition, and in consideration of the opportunity to participate in the Competition, each entrant agrees to be bound by and observe these Conditions of Entry.
1.3. The promoter of the Competition is Channel Nine, The Today Show 24 Artarmon Road Willoughby, NSW, 2068.
2. Who may enter
2.1. Entry into the Competition is open to residents of South East Queensland only who are;
(a) currently enrolled in grades 6,7,8 or 9 at a school within the Channel Nine Queensland’s viewer area, AND
(b) Interested in becoming the Nine New Junior Cadet for 2008, AND
(c) Must be able to attend the regional finals as stipulated in point 4 AND
(d) Have prior approval from their Parent and teacher to enter
3. The officers, managers and employees of the Promoters, their related corporations and its associated agencies, and the immediate family of such officers, managers and employees of the Promoter, ACP Magazines Ltd, ninemsn Pty Ltd, Ticketek Pty Ltd, 5th Finger Pty Ltd and their immediate families, and all companies and agencies associated with this promotion, are not eligible to enter the Competition.
4. How to enter
To submit a valid entry participants must;
(a) visit www.ninenewsjuniorcadet.com.au, complete the online registration form with their First Name, Last Name, email address, Contact phone number, Name of their school, their grade, teachers name, school address, city, state, and postcode,
AND
(b) Select from the following regions that they would like to enter (each entrant must enter the regional division closest to their school)
(i) Westfield North Lakes - North Lakes Drive, North Lakes, QLD 4509– Thursday 28/08/08 at 1800 AEST
(ii) Springfield Town Centre - 1 Main Street, Springfield Central, QLD 4300– Saturday 30/08/08 at 1000 AEST
(iii) Hyperdome Shopping Centre - Cnr Pacific Hwy and Bryants Rd, Loganholme, QLD 4129 – Thursday 4/09/08 at 1800 AEST
(iv) Robina Town Centre - Robina Town Centre Drive, Robina, QLD 4230– Saturday 06/09/08 at 1000 AEST
(v) Westfield Carindale - 1151 Creek Rd, Carindale, QLD 4152– Thursday 11/09/08 at 1800 AEST
AND
(c) Select one of the following categories that they would like to enter;
(i) News Presenter
(ii) Sports Presenter
(iii) Weather Presenter
(iv) News Reporter
4.2. Entry to the competition is free however entrants may incur standard internet fees to enter as well as travel fees to attend the regional and grand finals. All ancillary costs associated with entering this promotion are the responsibility of the entrant
4.3 It is a condition of entry that each entrant/ participant sign a legal release in a form to be determined by the Promoter in its complete discretion. For the purposes of this promotion, it will be necessary that each participant has their parent and/or legal guardian sign the legal release on their behalf.
5. Divisions
Students will be broken into two divisions;
5.1. all entrants in grades 6&7 will be placed in 6&7 division
5.2. all entrants in grades 8&9 will be placed in 8&9 division
5.3. all students will compete against each other in the regional finals and the grand final for their division
6. Registration in to Competition
6.1. Places are limited to 80 entrants per region. The registration to the competition commences at 0600 AEST on Monday 18/08/08 and entries will close on Sunday 23/08/08 at 1800 AEST or when the entries reach their regional limit of 80.
6.2. No responsibility will be accepted for late, lost or misdirected entries, or entries not received by the Promoter for any reason whatsoever.
6.3. Only one entry per person will be accepted.
7. Selection process
7.1. The promotion is a game of skill and chance plays no part in determining the winners. All entrants will be separated into their respective category prior to judging to ensure each entrant has a fair and equal opportunity of winning. Each entrant will be judged on presentation and delivery.
7.2. The best 80 entrants from each region will be accepted (40 from years 6&7 40 from years 8&9)
8. Regional Final
8.1. The Regional finals will be held at the following locations
(a) Westfield North Lakes - North Lakes Drive, North Lakes, QLD 4509– Thursday 28/08/08 at 1800 AEST
(b) Springfield Town Centre - 1 Main Street, Springfield Central, QLD 4300– Saturday 30/08/08 at 1000 AEST
(c) Hyperdome Shopping Centre - Cnr Pacific Hwy and Bryants Rd, Loganholme, QLD 4129 – Thursday 4/09/08 at 1800 AEST
(d) Robina Town Centre - Robina Town Centre Drive, Robina, QLD 4230– Saturday 06/09/08 at 1000 AEST
(e) Westfield Carindale - 1151 Creek Rd, Carindale, QLD 4152– Thursday 11/09/08 at 1800 AEST 8.2. All students with confirmed registration will be able to enter their selected regional final
8.3. Students will be required to write a 15 to 20 second script on their category to present to camera on date and time specified their regional final.
(a) Assistance to write the script from teachers and parents is accepted
8.4. All entries will be judged on presentation and delivery of their piece to camera at the regional finals
8.5. At the conclusion of each regional final, the judges will select eight (8) regional finalists from each location to move through to the Grand final. One for each of the four categories in each division.

9. Grand Final
9.1. The Grand final will be held at Queens Street Mall on Sunday 14th September 2008
9.2. The 40 regional finalists will compete in the grand final for the title of Nine News Junior Cadet champion in their division.
9.3. The Students will have the choice of presenting the same 15-20 second piece as used in the regional finals or a new piece.
9.4. At the conclusion of the Grand final, the judges will select one winner from each division as the Nine News Junior cadet champion to win.
10. Prizes and notification
10.1. Minor winners
(a) All entrants into the competition will receive a complimentary gift bag from the Nine Network and sponsors valued at up to $15 including GST
10.2. Major winners
(a) There are 2 Major winners (one for each of the following categories):
A) years 6/7
B) Years 8/9.
(b) The Major winners of the Nine News Junior Cadet competition will each win the Major prize pack valued at $5457.50
Each prize pack includes
(i) $5,000 cash cheque for their school Cheque component of the prize will be awarded in the form of a cheque made in favour of the winners school.
(ii) 1 x gift pack from the Nine Network valued at up to $250 including GST
(iii) 1 x Nine New Junior Cadet Champions trophy
The Maximum value of all prizes is up to $10,915 Including GST
11. The Promoter’s decisions are final and no correspondence will be entered into. Prizes cannot be exchanged and cannot be taken as cash. Prizes can only be transferred at the absolute discretion of the Promoter.
12. All entries are deemed to be received at the time of receipt by the Promoter, not time of transmission by the entrant.
13. Release and indemnity
13.1. The information entrants provide will be used by the Promoter for the purpose of conducting this promotion.
13.2. To the extent that the participant/ entrant is unable by law to release and discharge the Promoter, its agents, officers and employees in respect of a Claim, or if for any reason the release above is not effective, the participant / entrant and/or their legal guardian indemnifies and undertakes to keep indemnified the Promoter, its agents, officers and employees from and against all and any Claims that any person has or at any time may have against the Promoter and/or its agents, officers and employees for or in any way arising out of or in connection with the participant/ entrants participation in the Competition and/or use of or participation in the Major Prize.
13.3. For the purpose of these Conditions of Entry, “Claim” means any allegation, debt, cause of action, liability, claim, proceeding, suit or demand of any nature howsoever arising in respect of any loss or damage (including any direct, economic, special or consequential loss or damage), cost, expense or other claim, whether based in tort (including but not limited to negligence on the part of the Promoter or an agent, officer or employee of the Promoter), contract, statute, equity or otherwise and whether present or future, fixed or unascertained, actual or contingent and “Claims” has a corresponding meaning.
13.4 All entries submitted in connection with this promotion become the property of the Promoter. Entries will not be returned to any entrant. As a condition of entering into this promotion, each entrant agrees to assign all of their rights, title and interest (including copyright) in and to their entry to the Promoter. Each entrant warrants to the Promoter that each entry submitted is an original creative work of the entrant which does not infringe the rights of any third party. The entrant agrees to indemnify the Promoter against all claims and costs by third parties arising from a breach of the warranty set out in this condition. The Promoter is entitled to use any of the entries submitted for any purposes at its discretion, including for any future promotion, marketing and publicity purposes.
13.5.1 By entering this promotion that all participants agree to be interviewed and photographed by the Promoter (or their agents) at any time during participation in the promotion for a story or feature on this promotion to be developed and featured by the Nine Network Australia Pty Ltd (or any other form of media it deems suitable). This story will feature in [National Nine News] at a time to be determined by the Promoter. All control relating to any such feature will remain with the Promoter at all times. In addition, the winners may be requested to attend a film shoot at the Promoters QTQ studios to be included in any feature appearing on the Nine Network Australia or on the Nine Network Website website/s. Any costs associated with attending this filming is the responsibility of the participant/ winners.
14. Limitation of Liability
14.1. No responsibility will be taken by the Promoter or its agents, officers or employees for lost, ineligible, misdirected or late entries due to technical reasons or any other reason. Entries that are not genuine are incomplete or late or are in any way fraudulent will be declared void.
15. INTERNET
If for any reason this competition is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures or any other causes beyond the control of the Promoter which corrupt or affect the administration security, fairness, integrity or proper conduct of this competition, the Promoter reserves the right in its sole discretion to disqualify any individual who tampers with the entry process, and to cancel, terminate, modify or suspend the competition.
15.1
The Promoter assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorised access to, or alteration of, entries. The Promoter are not responsible for any problems or technical malfunction of any telephone network or lines, computer online systems, servers or providers, computer equipment, software, failure of any email or entry to be received by the Promoter on account of technical problems or traffic congestion on the Internet or at any Website, or any combination thereof, including any injury or damage to participant's or any other person's computer related to or resulting from participation or downloading any materials in this competition. CAUTION: ANY ATTEMPT TO DELIBERATELY DAMAGE ANY WEBSITE OR THE INFORMATION ON A WEBSITE, OR TO OTHERWISE UNDERMINE THE LEGITIMATE OPERATION OF THIS COMPETITION, MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, WHETHER SUCCESSFUL OR NOT, THE PROMOTER RESERVES THE RIGHT TO SEEK DAMAGES TO THE FULLEST EXTENT PERMITTED BY LAW.
16. General
16.1The Competition is a "game of skill". All valid entries do not form part of a random draw, but are judged on the basis of creativity.
16.2 All eligible entries will be included. No correspondence will be entered into and the judge’s decision is final.
16.3 If for any reason this promotion is not capable of running as planned, including due to infection by computer virus, bugs, tampering, technical failures or any other causes beyond the control of the Promoter, which corrupt or affect the fairness or integrity or proper conduct of this promotion. The Promoter reserves the right to alter the starting or closing date of the competition to suit programming without notice. The Promoter reserves the right in its sole discretion to disqualify any individual who tampers with the entry process and to cancel, modify, terminate or suspend the promotion, subject to State Regulation.
16.4 Promoter reserves the right to verify the validity of entries and to disqualify any entry which, in the opinion of Promoter, includes objectionable content, profanity, potentially insulting, inflammatory or defamatory statements and disqualify any entrant who tampers with the entry process, who submits an entry that is not in accordance with these Terms & Conditions of Entry or who has, in the opinion of Promoter, engaged in conduct in entering the Promotion which is fraudulent, misleading, deceptive or generally damaging to the goodwill or reputation of the Promotion and/or the Promoter.
17. PRIVACY
The collection, use and disclosure of personal information provided in connection with this offer is governed by the Privacy Notice (available from Nine Network Australia Pty Ltd reception).
18. ENTIRE CONDITIONS
These conditions constitute the entire agreement of the parties relating to the entry and the conduct of the competition.
